Abstract

This paper aims to track the construction of maqāṣid al-sharī‘ah reasoning and reading patterns of maqāṣid al-sharī‘ah according to Ibn Taymīyah perspective. The study of the philosophy of Islamic Law in the perspective of Ibn Taymīyah in Islamic thought is still not much discussed, even not yet formulated with a comprehensive framework of construction of reason. Maqāṣid al-sharī‘ah in Ibn Taymīyah’s perspective has a reciprocal reading pattern in quadric jalb al-maṣlaḥah and daf‘ al-mafsadah at one time simultaneously. These quadrics here are relational dialectics between min jānib al-wujūd and min jānib al-‘adam. Ibn Taymīyah as one of the most knowledgeable scholars of science has a unique reading pattern on how the legal texts (ayāt al-aḥkām) and their intentions (al-maqāṣid) are dialecticalized.

Abstract

Abstract: What is the main factor of terrorism; Islamic doctrine, or political factor? There are three mainstream opinions provide theoretical reviews. Firstly, those who believe that the justification of acts of violence to terrorism is an inherent product of religious doctrine. Secondly, those who consider that terrorism is a profane matter have absolutely nothing to do with religion. Thirdly, the opinion which states that terrorism is syncretism and interrelated modification between politics and religion. This article tries to examine the three views above by dissecting other perspectives in order to get a clearer picture of the discourse of Islamism transforming into a radical movement leading to terrorism. Doctrinal and political motives are so strongly integrated and overlapping in the structure of the motives and actions of these radical groups. Departing from the view that Islamism is a movement that aims to make radical-revolutionary changes in social structure institutions, this article collects theories that can be used as maps to understand the construction of Islamism.

Abstract

Baḥth al-masā’il is a forum in which traditionalist Muslims of Nahdlatul Ulama get their fatwas. Nahdlatul Ulama practices taqlīd and therefore madhhab in its fatwa by relying upon opinions of especially Shāfi‘ī jurists. Since 1992, some forward-minded people within Nahdlatul Ulama introduced the use of madhhab manhajī through istinbāṭ method in addition to madhhab qawlī. However, the co-existence of these two methods creates everlasting polarization within Nahdlatul Ulama. There once the division of application, though, in which manhajī was employed in mawḍū'īyah cases and qawlī was practised in wāqi‘īyah cases, but it did not last long. The National Congress of Nahdlatul Ulama in 2015, when istinbāṭ of madhhab manhajī was discussed once again, unveiled fierce debates between supporters of the two methods. The East Java Branch of Nahdlatul Ulama, which are fervent supporters of qawlī, insists on its sole employment in the fatwa. All their baḥth al-masā’il wāqi‘īyahs after the 2015 Congress use qawlī. However, manhajī start to appear in their baḥth al-masā’il mawḍū‘īyah, especially in cases where various approaches should be deployed, such as fatwa on Islam Nusantara.

Abstract

Materialism and consumerism influence people’s consumption behaviour, considering that the purpose of consumption is not only to fulfil life’s needs but also for mere satisfaction. The purpose of this study is to examine the importance of Islamization of economics, especially the theory of consumption, referring to the theory of Islamization of science of al-Attas and al-Faruqi. The results of this study indicate that the Islamization of economics in consumption theory is very important to liberate society from the secular doctrine of materialism; Islamizing the goods and services concept by limiting it with the term of ḥalālan ṭayyiban; incorporating the element of maṣlaḥah as the main foundation in consumption instead of satisfaction. With the Islamization of economics on consumption theory, it is hoped that it can provide a change and enlightenment, particularly in the consumption behaviour of the Muslim community, and generally for economic development.

Abstract

For Javanese, one way to cure the sick is to do suwuk (jampi). Suwuk tradition, namely healing by reciting mantras (certain readings) that are blown on the crown of the patient and sometimes also use water media, especially for some modern Muslims, was initially seen as a healing practice that contains elements of shirk because it was considered not in accordance with the principles of Islamic 'aqīdah. Today, this view begins to change after a normative source has been found from a number of traditions that allow ruqyah that works similar to suwuk. It was also strengthened by the results of experiments and the findings of a number of scientists about the effect of certain readings and the wonders of water. This article will explain the tradition of suwuk which is the same as ruqyah, then elaborate normative sources of the Qur’ān and the Ḥadīth which legalize it and the view of modern science that supports it, so that its existence is still relevant to modernity.

Abstract

Since Nahdlatul Ulama scholars have been preaching Islamic knowledge using language and the social culture of their audience, the message of preachings (da‘wa) is easily absorbed by the audience. Such Islamic da‘wa is recognised as a cultural Islamic da‘wa, making Islam accommodative to the local culture without reducing any of the values of Islamic principles; and challenging the radical Islamic discourse strongly emerg-ing in post-reformasi Indonesia. This article would revisit the concept of cultural Islamic da‘wa developed by Nahdlatul Ulama scholars, by tracing the strong chains of its genealogies, then exploring the strategies conducted in line with the dream of displaying a “soft” face of Islam in Indonesia. As a result, this article argues that the cultural Islamic da‘wa of Nahdlatul Ulama scholars is inspired by, even adopts to, that of Walisongo in the 15th and 16th centuries Indonesia. Its aim is to make sharī‘ah applicated substantively, other than normatively, by the society, through a strategy of cultural approaches, rather than structural ones.

Abstract

This article seeks to explore Niẓām al-Mulk’s political career and his contribution to Islamic political thought. As a prominent wazīr of two Seljuq sultans, Alp Arslan and Malikshah, Niẓām al-Mulk played an important role in running the government for almost 30 years. His adherence to Sunni theological doctrines and Shafi'i school of law has made him a defender of Sunnism against other sects like Ismailism. As a political figure and thinker, Niẓām al-Mulk regarded justice and religion as a fundamental basis for the state. In Siyāsat-nāma, he elaborates many political bodies needed to build a strong state and government, such as wazīr, qādī, tax collectors, military, and intelligent agency. It can be argued that Niẓām al-Mulk’s political thought as formulated in his work, Siyāsat-nāma (the Book of Government), is based on his political and governmental experiences, his understanding of Islamic doctrines, and Persian political traditions.
